Supreme Court Opinion Cites to GW ILR

On April 17, 2013, the United States Supreme Court published its decision in Kiobel v. Royal Dutch Petroleum Co., including a citation to The George Washington International Law Review.  In an opinion concurring in the judgment, Justice Breyer, joined by Justices Ginsburg, Sotomayor, and Kagan, cited to Robert C. Johnson, Anita Ramasastry, and Mark B. Taylor’s article Translating Unocal: The Expanding Web of Liability for Business Entities Implicated in International Crimes, 40 Geo.Wash. Int’l L. Rev. 841, 886 (2009).  The Court’s opinion declined to extend extraterritorial jurisdiction to certain claims under the Alien Tort Statute.  The Justices cited Johnson, Ramasastry, and Taylor when discussing countries that use universal criminal jurisdiction to allow parties to seek civil damages in criminal proceedings for particularly heinous crimes.

Congratulations to the authors for their contributions to scholarship and the law.

Forthcoming Article

The following is a short abstract of the Article, Is “Defamation of Religions” Passé?  The United Nations, Organisation of Islamic Cooperation, and Islamic State Practices: Lessons from Pakistan by Javaid Rehman and Stephanie E. Berry, which will be published in volume 44 of The George Washington International Law Review.  The Article addresses “defamation of religions” in international law, a concept likely to take on increased significance after a recent online video insult to Islam gave rise to violent protests and attacks on U.S. Embassies across the Middle East.
